It is a matter of the "rights of man"...the state of nature existed for men to exploit and the tacit consent that we give to our governing bodies (via election and the like) stated that we believed that these entities would act in our behalf...for the good of all...this of course is far from what the Founding Fathers sought to achieve but it was the nature of the Lockian argument initially.
