:I also as a diploma in law student accept this theory. The law double jeopardy is wrong because it doesn't serve any form of justice whatsoever. Imagine having a loved one killed, going to court to put the murderer behind bars and then finding out that there is not enough evidence so the person is found not guilty. Now picture a few years later DNA evidence (or some other form of evidence) is found. That person cannot be tried again under the double jeopardy law. They can admit that they killed that person but they can not go to jail for murder.
