I need to ask a few questions before I can give any suggestions. First, what trial are you talking about, the one at the Diet of Worms, or some imaginary trial in which every historical Catholic objection to Luther is considered? Second, innocent of what, in particular? I think Augustine probably would agree with Luther on some points and disagree with him on others.
But of course, this is all highly theoretical, since Augustine's historical situation was so different from Luther's.
